1. Agreement and service
These Terms of Use govern your use of Gambit, the Digital Futures Symposium 2026 workshop application, including its rooms, notes, AI-assisted activities, commitment pages, and follow-up features (the Service). The Service is operated by Menkath Inc. (Menkath, we, us, or our).
By checking the acknowledgement on the entry screen or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. Workshop participation
Use the Service only for the workshop and related follow-up. Provide a name you are entitled to use, respect other participants, and do not submit unlawful, abusive, discriminatory, threatening, malicious, or privacy-invasive material.
Do not submit passwords, payment-card details, government identifiers, health information, or other sensitive personal information. You are responsible for the material you choose to submit and for your decisions based on workshop discussions or AI outputs.
3. Your content, visibility, and commitments
You retain ownership of the content you submit. You give Menkath a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and process it only as needed to operate, secure, facilitate, and improve the workshop and its follow-up.
Your display name and group writing are visible to the relevant participants and facilitators. A commitment can be published publicly only after every person named on it approves publication on their own device. You may withdraw an approval where the Service provides that control.
4. AI and speech-to-text
When enabled for a room, an AI assistant processes group writing and commitment draft text to support workshop discussion. Your name is not attached to the text sent to the assistant. AI output can be inaccurate, incomplete, or unsuitable, and must not be relied on for legal, medical, financial, employment, safety-critical, or other high-impact decisions.
The optional Speak control uses supported browser or speech-provider services to turn speech into transcript text at the cursor. Gambit stores transcript text, not audio. Your browser, operating system, or speech provider may process audio under its own terms and privacy practices. Speak never submits a form for you.
5. Service availability
We may change, suspend, or discontinue parts of the Service where reasonably necessary for workshop operations, maintenance, security, privacy, or safety. The Service and AI features may be unavailable, interrupted, or contain errors.
6. Intellectual property and feedback
Menkath and its licensors retain all rights in Gambit, including its software, design, and materials, except for your submitted content. If you provide feedback, you allow Menkath to use it without restriction or compensation to improve the Service.
7. Disclaimers and liability
To the maximum extent permitted by law, the Service and AI outputs are provided as is and as available, without warranties of any kind. Menkath is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded.
8. Suspension and termination
We may suspend or end access if you breach these Terms, create risk for others, or interfere with the workshop. The provisions about content, privacy, disclaimers, liability, and dispute resolution continue after access ends.
9. Changes to these Terms
We may update these Terms by publishing a revised version and its effective date. If a change materially affects how personal information or submitted content is handled, we will provide notice and seek consent where required by law.
10. Governing law and contact
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Ontario courts have exclusive jurisdiction, subject to rights that cannot legally be waived.
